By Bill Dunigan Today everyone is looking for that special job that will suit their exact needs. In this day and age we all have circumstances, situations, obligations, etc. that make demands on our time and energy. In most cases students will get a job that will give them enough money to pay for the fuel for their car and a few nights out, assuming they even have a night off. Why should any student who is studying hard and working hard, and building up a huge debt in the process, spend what little available time they have left slaving away for someone else with minimal payback? The answer is simple. That's the way it has always been. Employers know that they can get cheap labor that can add and subtract, converse if necessary, sell, stock, clean, and on and on for very little pay or benefits. This is because the jobs that pay more and offer more are only available to someone they think will stay with them for a while and not be a transient for just a few months. However, today there is a way around this dilemma faced by thousands of students everywhere. It really is possible to make the money they need, have time to study, develop a social life, and at the same time build something for their future. That last one is something they can't even begin to think about in their current job situations. OK, so just what is this super magical answer you ask. Well it's nothing that new or different. It simply isn't usually thought of as an answer for students. However, I believe that it is perfectly suited for the situation. Students who are reliable, honest, and serious are the very ones who are geared up and ready to take the initiative of setting the wheels of their future in motion while taking care of today's needs. They are already multitasking on a daily basis. Why should they work for pennies for someone else when they could be in business for themselves? Yes, you read it correctly. They could decide when to work, when to have time off, when to give themselves a pay increase. While doing all of this they would also be able to build an income that could be there for them in the future. Sound impossible? Quite the contrary. Today it is more than possible, it's fact. The truth is they have a choice today that allows them to choose the direction of their life rather than passively letting things happen. They also are savvier in general and ready to take that plunge that could change their present situation. All they need is the right vehicle. I strongly believe that vehicle goes by the name of Network Marketing. There are numerous ones out there and some are better than others. It does not make any difference if you are married or not. When two people value their relationship but have differences they are failing to resolve, something must be done. If nothing is done, the relationship will degrade, eventually resulting in either a breakup, divorce or the couple staying together but living an unhappy life. You obviously didnt form your relationship with this outcome in mind. One thing that you must understand is that it will take some effort to turn things in the right direction in your relationship. Any and all relationships take some nurturing to keep them healthy and happy. If you dont believe this or are not willing to put forth any effort at all, reading this article may be a waste of your time. If you are ready to take a positive step that could produce amazing results, please read on. Constructive communication is downright scary for many couples. Too many times the recipient of the message feels they are being attacked and goes into a defensive mode, many times with a counter-attack. When this happens, not only the constructive facet of communication is lost, but future communication is also jeopardized resulting in a destructive pattern. Rules of communication must be set, agreed to, and adhered to during your conversations. Planned discussions with rules are a great way to foster constructive communication. When discussions are planned in advance by both parties, decided when and how often they are held, a potential threat of whos attacking who is removed. For example, you and your partner agree to talk about your relationship every Sunday after lunch at 1:00 PM. You agree to stick to this schedule for 2 months, after which you decide if this schedule is working well or not. If youve made a lot of progress by then, perhaps you could switch to a monthly schedule. Below, I will summarize the steps to this simple, but effective approach to healthy communication. 1. Sit down with your partner and come to agreement on the following. What times and days will you have your discussions? Agree on rules. Discussions are always to be constructive. Try to present your case in a non-aggressive manner. When you do this it makes me feel this way is a better approach than You must hate me and not care about me because you always do this Always remember to stay calm. Arguing or raising your voice is not an option. After a couple meetings, you may have most of your main issues on the table. If you get through these initial meetings, it should get easier as you go. 2. At the beginning of each meeting, each partner will take turns speaking. When one is speaking, the listener should only listen and not interject comments. This is a time for the listener to do a self-evaluation and not look for a good comeback, but truly try to see it from their partners viewpoint. The speaker should remember to follow the rules of healthy communication. Do not portray your case as blaming or you will not get the results you are seeking. You may want to take notes about what your partner is saying and read those notes throughout the week. If you care about making changes for the good of the relationship, taking notes will help you keep your partners concerns fresh in your mind so you can act on them. 3. After each of you have voiced your concerns, now its time for you (again, one at a time) to recognize each others progress since the last meeting. Discuss any changes the other has made in their habits or behavior, no matter how small. Let them know that you noticed their changes and appreciate it. Remember, it takes time to change. Dont expect rapid changes in your partner or youll disappoint yourself. If this is your very first meeting, simply tell your partner some things you appreciate about them. Finishing each meeting with positive discussion will help to lighten the air. You dont want to leave a meeting with knots in your stomach! If youre a POD author, chances are close to impossible unless you deal with independent local bookstores which usually are more flexible and open to helping local authors. But as a rule, big chain stores wont stock a POD book, mainly because of lack of returnability and the poor (and mostly unfair) reputation of print on demand books. But, as I said, small independent bookstores are more open and flexible and more willing to take a small risk with a an unknown author. Though it is true that most people (about 52%) shop books at big chain stores, here your book will be lost amidst thousands. In a small bookstore, however, you competition will be less because there are not as many books on the shelves. Of course, most people go shopping for their books at the big chain stores, thus their popularity. If you want to market your book to bookstores, the first thing you need to do is to locate them. You also need to decide which type to contact. You may want to contact bookstores by genre or geographical are. If you live in Los Angeles and your book is a mystery, for instance, you may want to contact all mystery bookstores in your city first before moving to other geographical areas. Are You Ready To Conquer Your Canaan?

By Steven Lester The very first verses of the 5th chapter of Joshua tell us that the heathen nations in Canaan saw the powerful manner in which the Lord brought His children through the Jordan, and that they were totally demoralized by these events. It would seem that they were absolutely resigned to their fate. It would appear that this would be the perfect time for Joshua to lead the people forward into the attack. However, instead of commanding the people to go forward into battle, God commands them to stay at Gilgal and to do several things that on the surface seem very strange. It even appears that the things they are required to do put them at risk before the enemy. While the ways of the Lord may seem strange to us, God is always right on time. He knows what he is doing, even when we dont. It is not ours to understand what God wants us to do; it is for us to be obedient. You see, God never gets in a hurry! He has the liberty to take His time and do things on His schedule. While the things that appear in this chapter seem strange against the backdrop of impending battle, the truth of the matter is God is simply preparing His army to fight. He makes them engage in some things that appear odd, but let me remind you that Gods people often are involved in battles that go far deeper than the physical realm. In fact, before the battle ever begins in the physical, it has already begun in the spiritual. Gods battles are spiritual battles. If we expect to win these spiritual battles we must make the right kind of spiritual preparations. Israel appeared ready for the battle. They possessed a large army and they faced an enemy that was terrified at their presence. However, God knew that they would never be ready to fight and win the battle until the proper spiritual preparations had been made. That is what this passage is all about. The lesson taught here can help us in our spiritual battles. Are you ready to conquer your Canaan? If so, you must be willing to make the right spiritual preparations. Lets take a few minutes to consider the steps that Israel was commanded to take before they could conquer their Canaan. As we do, ask yourself whether or not these things have been taken care of in your life, because until they are, you will never be able to conquer your Canaan. I. RENEWING THEIR COVENANT WITH GOD (Joshua 5: 2-7) A. God reminds Israel that all men are to be circumcised B. Israel had to remove a small piece of skin as a sign of their covenant. We must remove those things that stand between God and us. C. To the Jew circumcision was a reminder that they were a marked people. D. Separation serves the same purpose in our lives. II. REAFFIRMING THEIR CONFIDENCE IN THE LORD (Joshua 5: 8) A. At this time Israel is camped in the midst of enemy territory, and after the men are circumcised, they are temporarily unable to fight, so it took great faith to obey God. B. Just as they had to demonstrate their faith and confidence in God by placing themselves in a place where only He could protect them, we must completely trust God having no concern for self. C. Over and over when Gods people arent able to take care of themselves God has demonstrated his ability and determination to do so. III. REMOVING THEIR CONDEMNATION BY THE LORD (9) A. The term reproach of Egypt has a reference to 2 events during Israels wilderness wanderings. On both occasions God threatened to destroy the nation. 1. When they made a golden calf and worshipped it as God. 2. At Kadesh-Barnea when they refused to enter the Promised Land. B. Up until this point they were still under reproach. Some of you may be living under reproach today because of past sins. C. Let me remind you that if you are a child of God you are no longer under condemnation, but you have been forgiven forever. D. For condemnation to be removed repentance must take place. IV. REMEMBERING THE COMMITMENT OF THE LORD (Joshua 5: 10-12) A. Israel once again celebrated the Passover, a celebration of remembrance of the salvation of the Lord. B. In times of spiritual battles we need to remember when: 1. God called us in love 2. He saved us by His grace 3. He forgave our trespasses 4. He kept us when we fell 5. He conquered our enemies in the past 6. He gave us hope when there seemed to be no hope C. Just as Israel needed to remember Gods commitment to them, they needed to remember their commitment to Him. V. RECOGNIZING THE CONTROL OF THE LORD (13-15) A. The final step in getting ready to conquer your Canaan is learning Who is in control. B. There is great blessing in allowing God complete control. As a matter of fact that is the only way true happiness will ever be attained. Are you ready to conquer your Canaan? Not if there is unrepented of sin in your life! Not is there is rebellion in your heart! Not if there are uncontrolled appetites for the things of this world. Not if you are filled with doubt and fear! Not if you have forgotten where the Lord has brought you from! Not if you, instead of Jesus is in control of your life! Do you want victory? If so, its time to deal with those things in your life that keep you from having it. Keep Advancing. By Tim Smith Whether its true or not, most everyone agrees that wedding DJs are expensive. A popular tip circulating the net is to replace your wedding DJ with an iPod and DJ your reception yourself. While this may sound like a great idea, there are some things to consider. Just as with any do-it-yourself project, you must be aware of all facets before you start. The first most important job for a good DJ is to play music that the crowd enjoys. A simple shuffle has no way of knowing who is dancing to what. A person does need to run things, but not just any person will do. Putting your 12 year old nephew won't do you any good. The person in charge of the music needs a large amount of music knowledge. A good DJ should have this knowledge. A good DJ should be able to identify a song based on a few bars hummed out of tune or a snippet of lyrics that are slightly incorrect. Your DJ must not have a fear of speaking in front of a crowd, and this is not as easy as it sounds. One simply has to think of all the Best men who have hemmed and hawed their way through a wedding toast with the microphone held at waist level. Also, does he/she know how to auction off a garter or any of the other traditional reception activities? If not, will the bride and groom want to do these things while they should be enjoying their guests? Oh, and just like you would give your wedding singer or officiant a tip for performing your ceremony, don't forget a gratuity for your impromptu DJ. Unless you're a music collector, chances are you don't have a music library with waltzes, polkas, old country, new country, oldies, classic rock, new rock, soft rock, hard rock, hip hop, dance, etc. And, unless you want to subject your guests to your musical tastes, you should probably buy a selection of these songs. If you're not up on popular waltzes and polkas, or don't know which songs are currently topping the country Top 40, search the web. $25 dollars should buy you enough music on iTunes to cover enough various musical tastes that most guests will enjoy themselves. Another task for a good wedding DJ is one who is covered by insurance. Sure, your homeowners policy *might* cover it, but I'd hate to see your premiums next year if an accident does occur. Don't think accidents will happen to you? Are you serving alcohol at your reception? If you're telling yourself, "All the drunk people I know never act like fools!", stop and think about that again. Besides, many venues require proof of insurance because they don't want to see their premiums raised because your grandma tripped on a speaker cable and broke her hip. Searching the web for "wedding event insurance" will yeild a whole crop of insurers who will give you a $1 million dollar policy for around $200. Equipment is of course another important factor a good DJ brings to your reception. Do you know where to get speakers? Or mics? Or Mixer?? Larger cities will have rental companies that can provide these things. You can even find many such companies by searching the web for "dj equipment rental". Most wedding sized systems rent for anywhere from $250 to $500 dollars per day. In most cases, you must provide a truck or van to transport the equipment. Now, do you know how to set these things up? If not, will the rental company give you a tutorial? Some rental companies will give you a tutorial when you pick the equipment up, but make sure to take notes, because if you have to call them later they will likely charge you for a service call. Some equipment rental companies will deliver, setup, and test their equipment as well as pick up later, but this is extra. That being said, if you KNOW your group will interact without being prompted (or just don't care if they interact or not), and if you've got a person with an encyclopedic knowledge of music that will run your iPod (instead of enjoying your reception), and you have adequate insurance to cover any accidents that occur due to your iPod setup, and you have a large enough music library to make sure everyone gets to hear the music they want, and you're able to get your hands on adequate dance lights and speakers, and will be saving money by spending $550 to $700 then by all means use an iPod. You honestly have no need for a DJ. If planning and organizing all this sounds like just one more hassle, you'd probably do better to hire a professional so that you can enjoy your reception and spend your first day as husband and wife doing something besides returning rental equipment. For a few dollars more you'll get professional equipment, professional knowledge from someone who has planned and performed at hundreds of weddings, peace of mind that any glitches will be resolved quickly, no hassles about tearing down equipment when the reception is over, and no worries about getting it back before you owe another day's worth of rental fees. You've Been Googled! Now You Have To Shut Down Your Web Site, Urged Defense Counsel

By Gerry Oginski Well, it finally happened. I'd been Googled. Not by my friends, but by my adversaries in a medical malpractice wrongful death case. Their googling apparently caused apoplectic seizures that rippled through the defense firms representing the doctors in my case that was marked final for trial on April 10, 2006 in Kings County, here in New York. The first inkling of trouble was a telephone call by adversary #1- someone who up until that time, I thought I had a good working relationship with. "Gerry, I want to give you a heads-up about an order-to-show cause that you'll be getting shortly," he said. "What's it about?" I asked. "Your website. We want you to shut it down for the duration of the trial," he answered. "What are you talking about?" I asked incredulously. "What could my website possibly have to do with a trial that we're supposed to start in one week's time?" I stated, having difficulty controlling my tongue and the tenor of my voice. "We think that potential jurors might be prejudiced if they read the material on your website, and that's why we want you to shut it down," he responded. Let me digress a moment. On my website which currently gets over 3000 unique visitors per month, I have over 65 articles that I have personally written, I have 200 frequently asked questions, I have 213 links to other resources, and over 285 news articles about verdicts and settlements across the country. In addition, I have posted deposition transcripts of doctors in cases I have handled that are de-identified. I have removed all identifying features in each of the depositions I have posted. The reason I posted these transcripts is to show people what I do, how I do it, and it makes for interesting reading. If one Google's my name, "Gerry Oginski" you will get 953 sites that refer to me and my website, my blog and other writings I've posted online. If you take off the quotations, you'll get 12,500 references to my name. If you do a Yahoo search with the same name in quotations, you will get almost 8,000 sites that refer to my name. The original Google search that my adversary performed "Anesthesia, wrongful death and Oginski" revealed his client's deposition in the very case we were about to try. This was the only posted deposition in an active case. Even though it was de-identified and you could not determine who it involved, he asked me to remove it from my site for the duration of the trial because of the possibility that a juror could find the de-identified transcript while doing a search and read it during the trial. After much debate, and knowing that there is no case law on this topic anywhere in New York, I agreed to voluntarily remove the deposition from my site. You would think that my willingness to be courteous and professional to my adversary would have ended this issue. It did not. He was still insistent that my website be shut down, because there was material on my site, "That if viewed by a potential juror, would prejudice that juror," he wrote in his motion papers. On April 10, 2006, when we appeared in the Medical Malpractice Trial Ready Part in Brooklyn, NY, my adversary was insistent that the Court shut down my site. He referred to three articles I wrote as being somehow prejudicial: "Insurance Companies and how they protect their profits," "5 Typical Defenses in a Medical Malpractice Case," and "Medical Malpractice: 10 Reasons Why Most Victims Won't Recover a Dime." The last article he cited because I include discussions about jurors biased by the insurance industry, the plaintiff's inability to hire good qualified experts, and the basic premise that 'juries like doctors'. Defense counsel's arguments were, impressively, based on total speculation. He argued that a potential juror might ignore the trial judge's instructions not to discuss the case with anyone, that he might go online and perform a search about the attorneys or the topic involved in the case, that he would actually find information about the case, and that he might be prejudiced by reading such material. He wrote: "We live in the 'Google' world where nearly everyone has access to the internet and many people perform internet searches as a means of obtaining information. Jurors, in fact, often attest to a desire to 'research' the issues or attorneys on the internet. As a result, it is possible or even likely, that at least one juror (or prospective juror) will review the above-describe prejudicial materials on the plaintiff counsel's web siteWhile an admonishment could be given by the trial judge, it is submitted that that would more likely result in an invitation to go to the aforementioned web site and provide a road map on how to get there." He also argued, "the limitation on free speech must apply to written statements disseminated by plaintiff's counsel in a medium known to be viewed by prospective jurors, such as the website of plaintiff's counsel in the very matter set to be tried before them." My argument was simple: 1. Shutting down my site would have absolutely no effect on a juror intent on ignoring the Court's instructions from doing online research, 2. All of the material posted on my website is freely available on the internet, and was originally posted on the internet first, and then added to my site later, 3. If the Court felt compelled to shut down my site, then logically, it would have to shut down every lawyer's website (including all defense attorneys) in every case that came on for trial in every County in the State of New York. (The Courts' response was, I think, facetious, "Maybe I will have to shut down every lawyer's site") 4. Shutting down my website would not only be unconstitutional- a judicial lockdown of my right to free speech, but would create undue hardship financially since I receive all of my direct cases from my online presence, 5. The information posted online is truthful and provides consumers with abundant information they need to know before they hire an attorney, 6. The Courts' curative instruction to any potential juror would be all that was needed to address potential extracurricular research on the attorneys or the topic involved in the trial, 7. A decision that required me to shut down my site, regardless of the duration, would have significant implications in the legal community, and would simply make bad law. The Court initially wanted to have the trial judge address this issue in chambers, before starting the trial. However, with persistent urging by the defense, he relented and agreed to render a decision on this novel issue 60 days after receiving opposition papers. Because of this personal attack on my website, the trial would not proceed forward until this issue was resolved. UPDATE With anticipation building, and only two weeks to go before the Brooklyn Trial Judge rendered a decision on whether to shut down my website, I settled the underlying malpractice case. With a window of opportunity quickly closing, my adversary finally got serious about settlement negotiations. I'm happy to report that we settled this wrongful death case just before the Court rendered a decision. This means that the Court no longer has the opportunity to render a decision about whether to shut down my website. Unfortunately, this does not prevent defense counsel in other cases from making the same kind of ridiculous argument as was made in my case. The argument was absurd- that potential jurors would ignore the trial judge's instructions and go online to do research about the lawyers and the medicine involved in the case. The defense felt that this would somehow prejudice a potential juror from fairly deciding the case. Nonsense. We are all inundated with information every day, whether by newspaper, radio, advertisements, magazines, and the internet, so that selectively shutting down one website would, in my opinion, be meaningless. This was just another attempt to delay a meritorious case. What will defense attorneys think of next? I read an online comment recently by an attorney who read what was happening with my website. He suggested that the lawyers should each have the ability to shut down three websites of their choosing, instead of having three choices to remove jurors during jury selection. Excellent idea!
